Arbitration and Waiver of Jury Trial

The Vietnam Arbitration Act, rather than any state arbitration law, will govern all arbitration under this Arbitration Clause. Each party agrees that any action stemming from or connected to these Terms and Conditions shall be handled by an arbitrator of Fluxmall DTG Company Limited preference. The decision made by the arbitrator is final and binding upon all parties involved. The customer is accountable for any costs correlated to such arbitration. Governing Law and Disputes
These Terms and Conditions shall be governed by the laws of Vietnam, without regard to its choice of law principles. The exclusive venue for all disputes arising from these Terms and Conditions shall be the Vietnamese People’s Court in Ho Chi Minh City. Each party hereby waives objections to personal jurisdiction and agrees to accept service of process by mail or other methods permitted by law.
Partial Invalidity
In the event that a court of competent jurisdiction deems any provision of these Terms and Conditions to be invalid, the remaining provisions shall remain in full force and effect. Products inspection policy
The Shipping Partner will receive the parcel from Fluxmall DTG Company Limited, check the quantity and seal the goods, and make a handover record with Fluxmall DTG Company Limited.
Postal items and parcels are considered complete postal items and parcels after the Shipping Partner has signed the receipt of the postal items or parcels in the Fluxmall DTG Company Limited ‘s delivery book or equipment handover record.
When delivering goods to the recipient, the Shipping Partner delivery staff will stay to supervise until the recipient completes the goods inspection process. No costs are incurred in this process.
In case the goods actually received do not match the package information (invoice, shipping note) and the error does not belong to the partner, the Shipping Partner prepares a Minutes as a witness.
In case the goods received do not match the shipping information (invoice, delivery note) and the error is due to the Shipping Partner, the Shipping Partner will make a record of the goods and forward it to the service department of Fluxmall DTG Company Limited to resolve.
Responsibilities of traders and organizations providing logistics services for providing goods documents during the delivery process
Fluxmall DTG Company Limited is committed to delivery on time. In case of violation of the time schedule, except in cases of force majeure, compensation will be made according to the regulations.
